PlantBeat Terms & Conditions

1. Introduction

These terms and conditions ("Terms") govern your use of the PlantBeat mobile application ("App") created by Caffeinated Software LLC ("Service Provider," "we," "us," or "our") as a Freemium service.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Service Description

PlantBeat is a plant care application that provides:

• Plant identification and diagnosis using AI technology
• Plant care tracking and scheduling tools
• Care reminder notifications
• Community features for plant enthusiasts
• Weather integration for plant care recommendations
• Premium features including enhanced functionality

3. Account Registration and Security

While registration is not mandatory for basic features, certain features require account creation. When you create an account:

• You must provide accurate and current information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You may not share your account with others or create multiple accounts
• Account deletion can be requested by contacting administrator@plantbeat.com

4. Age Requirements

PlantBeat is not available to children under 13. If you are under 13, you may not use this app.

Users between 13 and 17 years old may only use PlantBeat with the approval and supervision of a parent or legal guardian. By allowing a minor to use PlantBeat, the parent or guardian agrees to these Terms on their behalf.

5. Plant Care and AI Services Disclaimer

• AI plant identification and diagnosis features may not always be accurate
• Plant care recommendations are general suggestions and may not be suitable for your specific conditions
• The Service Provider accepts no liability for plant health outcomes, plant death, or any consequences resulting from following the App's recommendations
• Always consult with qualified plant professionals for serious plant health issues
• Weather data and care recommendations are provided for general guidance only

6. Community Features

PlantBeat may offer community features that allow you to share content with other users. When using community features:

• Content you post (photos, comments, posts) is visible to other signed-up users
• You retain ownership of your content but grant us a license to display it within the App
• You are responsible for the content you post
• You may not post content that is illegal, harmful, or violates the rights of others
• We reserve the right to remove content that violates these Terms

Content Moderation:

• Community content is moderated by AI to ensure it is plant-related and appropriate
• Images uploaded to the community must contain plants
• Images containing NSFW or inappropriate content are not permitted and will be rejected
• We reserve the right to remove any content and suspend accounts that violate these guidelines

7. Premium Subscription Terms

PlantBeat offers optional premium subscription services ("Pro") with the following terms:

Free vs Pro:

Credits:

• Credits are used for plant identification and diagnosis features
• Monthly credits do not roll over and reset each billing cycle
• Purchased credits do not expire and are always used after monthly credits are depleted
• Monthly credit amounts are subject to change; changes take effect after your next subscription renewal (yearly subscribers retain their current credit allocation until renewal)

Billing and Payments:

• Subscriptions are billed on a recurring basis (monthly or annually as selected)
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period in your app store account settings
• Payment will be charged to your app store account at confirmation of purchase
• Subscription management and cancellation must be done through your app store account settings

Refunds:

• Refunds are handled through your app store (Apple App Store or Google Play) according to their policies
• EU consumers have a 14-day right of withdrawal for digital purchases; however, by using the subscription features immediately upon purchase, you acknowledge that you waive this right once the service has been accessed
• For refund requests, contact your app store directly or reach out to us at administrator@plantbeat.com
• Nothing in this section affects any additional rights you may have under your app store's terms or under mandatory consumer protection laws in your country

8. Intellectual Property

Unauthorized copying, modification of the App, any part of the App, or our trademarks is strictly prohibited. Any attempts to extract the source code of the App, translate the App into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the App remain the property of the Service Provider.

9. Privacy

Your use of PlantBeat is also governed by our Privacy Policy, available at https://plantbeat.net/privacy.html. By using the App, you agree to the collection and use of your information as described in the Privacy Policy.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or where such liability cannot be excluded or limited under applicable law (for example, certain consumer protection laws in the EU or UK).

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App or by email. Your continued use of PlantBeat after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law provisions.
